Welcome to MyQuals. These Terms and Conditions ("Terms") govern your access to and use of the MyQuals mobile application and associated services ("the App" or "the Service"). By using our App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.
By accessing or using MyQuals, you confirm that you are at least 18 years of age, or that you have the consent of a parent or legal guardian if under 18. You agree to comply with these Terms, which form a binding agreement between you and MyQuals.
MyQuals is an Australian-based application designed to securely store and display Statements of Attainment issued by Registered Training Organisations (RTOs) under the Australian Vocational Education and Training (VET) framework. The App functions as a digital portfolio of your accredited training achievements.
To access key features of the App, you must register for a user account. You agree to:
- Provide accurate, current and complete information when registering
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorised access or suspected breach of your account security
We reserve the right to suspend or terminate any account found to be in breach of these Terms.
You must use the App in accordance with all applicable Australian laws and regulations. You agree not to:
- Engage in unlawful, fraudulent or harmful conduct
- Use the App to harass, defame, abuse or threaten others
- Impersonate any person or entity
- Attempt to circumvent security measures or gain unauthorised access
- Upload or transmit malicious code or content
We reserve the right to remove any content or suspend access if we believe your use violates these conditions.
As part of certain promotions or contests, MyQuals may request users to submit:
- A personal photograph; and
- A Government-issued photo ID (e.g. driver licence, passport, proof of age card)
These materials are collected exclusively for the purposes of identity verification, contest eligibility, and fraud prevention. Submission is voluntary but may be required for participation in specific campaigns.
All data submitted in this context will be handled in strict accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Information is encrypted, securely stored, and access is restricted to authorised personnel only.
All intellectual property rights in the App, including content, branding, logos, software, and design, are owned by or licensed to MyQuals. You are granted a limited, non-exclusive licence to use the App for personal, non-commercial purposes. You must not copy, reproduce, distribute or modify any part of the App without our prior written consent.
To the extent permitted by law, MyQuals and its officers, employees and agents shall not be liable for any direct, indirect, incidental or consequential loss or damage arising from your use of the App. This includes, but is not limited to:
- Loss of data
- Unauthorised access to your account
- Downtime, errors or system failures
- Loss resulting from reliance on displayed Statements of Attainment
Nothing in these Terms excludes your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
We may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or engage in conduct that we reasonably believe is harmful, unlawful, or contrary to the intended use of the Service.
MyQuals may update these Terms from time to time. Any changes will take effect immediately upon being published in the App. You are encouraged to review these Terms periodically to stay informed. Continued use of the App following any amendments constitutes acceptance of the revised Terms.
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising under or in connection with these Terms.
